Adamawa Police to Appeal Court Ruling on Kidnap Suspect’s Damages
The Adamawa State Police Command has announced plans to appeal a Yola High Court ruling ordering it to release a defendant in a kidnap case and pay N5 million in damages for alleged wrongful detention.
The command’s spokesperson, SP Suleiman Nguroje, disclosed this in a statement on Thursday, expressing dissatisfaction with the judgment delivered on Wednesday, Jan. 22, in favor of the defendant, Hammadu Musa.
Nguroje stated that Musa was arrested by local vigilantes on suspicion of kidnapping and subsequently handed over to the police for investigation.
“After a thorough investigation, a prima facie case was established, and the defendant was charged to court. The case file was also forwarded to the Director of Public Prosecutions at the state Ministry of Justice for legal advice and further prosecution,” Nguroje said.
He emphasized that the command adhered strictly to legal procedures, adding that the defendant’s detention was court-ordered and not a violation of his fundamental rights.
“It is important to clarify that the defendant was remanded at the Correctional Service Facility in Yola by court order during the trial period. The police did not unlawfully detain him in any facility,” he said.
The command assured the public that it would, in collaboration with the Ministry of Justice, appeal the High Court’s decision to ensure justice is upheld.
